Terms of Service

1. Acceptance of Terms

By creating an account or using KetoSense (the "App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App. These Terms form a legal agreement between you and Aria Commerce (Exempt dealer under Maayan Milevsky Bassan) ("we," "us," "KetoSense") — not Apple Inc. or Google LLC (see Section 12).

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. KetoSense is not directed at children and we do not knowingly collect information from anyone under 16.

3. Description of Service

KetoSense is a nutrition-tracking application that helps you log meals, estimates macronutrients (net carbs, protein, fat, calories) using AI-assisted and manual methods, generates recipe suggestions, and surfaces patterns in your logged data. Some features require an active subscription ("KetoSense Pro").

4. Medical Disclaimer

KetoSense is not a medical device and does not provide medical advice. All macro estimates, recipes, targets, and insights in the App are for general informational and educational purposes only.

• Nutritional estimates — whether AI-generated or from our built-in calculators — are approximations, not laboratory-verified values. Do not rely on them for managing a diagnosed medical condition without your doctor's guidance.
• The App's health-screening step is designed to flag certain conditions (including pregnancy, insulin-dependent diabetes, and a history of disordered eating) for which a ketogenic diet carries specific risks. This screening is not a substitute for professional medical evaluation, and a "pass" through it is not medical clearance.
• Always consult a physician or registered dietitian before starting a ketogenic diet or any new eating pattern, particularly if you are pregnant, nursing, managing diabetes or another metabolic condition, have a history of an eating disorder, or take medication that interacts with changes in diet.
• Never disregard professional medical advice or delay seeking it because of something you read or calculated in KetoSense.

5. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

6. Subscriptions (KetoSense Pro)

KetoSense Pro is an auto-renewing subscription offered through the Apple App Store or Google Play. It includes convenience and advanced features (such as one-tap logging, meal duplication and advanced reports) and a daily allowance of AI credits. The daily allowance resets each day, does not roll over, and does not provide unlimited AI usage.

• Billing: Payment is charged to your App Store or Google Play account at confirmation of purchase.
• Auto-renewal: Your subscription automatically renews for the same duration and at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Managing or cancelling: You can manage or cancel your subscription anytime in your device's App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period; you keep access until then.
• Free trial: New accounts may include a free trial period, disclosed at signup. If you do not cancel before the trial ends, your chosen plan begins automatically at the price shown at the time of purchase. Any unused portion of a free trial is forfeited once you purchase a subscription.
• Price changes: We will notify you in advance of any price increase affecting your subscription, as required by the applicable app store.
• Refunds: All billing is handled by Apple or Google. Refund requests are subject to their respective policies, not ours.

6A. AI Credits (Top-ups)

You can buy AI credits as a one-time, consumable in-app purchase through the Apple App Store or Google Play, with or without a subscription.

• What credits are for: Credits are used to run AI features, such as AI meal logging, nutrition-label scans, recipe generation and import, and recipe images. Each feature uses the number of credits shown in the App before you use it; these amounts may change.
• When credits are used: Credits are used when a request is processed, including when the result turns out to be unusable. For Pro subscribers, the daily allowance is used before purchased credits.
• Expiry: Purchased credits do not expire.
• No cash value: Credits have no cash value, cannot be transferred or exchanged, and are removed if you delete your account.
• Refunds: If a credit purchase is refunded by Apple or Google, the credits it granted are removed from your balance.
• Credits and Pro: Credits pay for AI usage only; they do not unlock KetoSense Pro features.

7. AI-Generated Content

KetoSense uses a third-party AI provider (OpenAI) to power AI Chef recipe generation and natural-language meal-macro extraction. AI-generated recipes and macro estimates:

• Are estimates, not verified nutritional facts — see Section 4.
• May occasionally be inaccurate, incomplete, or fail to fully honor a stated dietary restriction. Always review ingredients and macros yourself before relying on them, especially if you have a food allergy.
• Are generated based on what you type and your saved profile information (as described in our Privacy Policy).

If the AI service is unavailable, KetoSense falls back to a built-in deterministic estimator, which is also an approximation.

8. Your Content

You retain ownership of the meal descriptions, photos, and other content you submit ("Your Content"). By submitting Your Content, you grant us a license to process, store, and transmit it (including to our AI and infrastructure providers) solely to provide and improve the App's functionality. You represent that Your Content doesn't violate any law or third party's rights.

9. Prohibited Uses

You agree not to: misuse the App to violate any law; attempt to bypass rate limits, subscription gating, or security controls; reverse-engineer the App beyond what's permitted by applicable law; or use the App in a way that could harm, disable, or overburden our infrastructure.

10. Intellectual Property

The App, its design, and underlying software are owned by Aria Commerce (Exempt dealer under Maayan Milevsky Bassan) and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

11. Termination

You may stop using the App and delete your account at any time from Settings — this immediately and permanently deletes your account and associated data. We may suspend or terminate your access for violating these Terms.

12. Apple App Store Terms

If you downloaded the App from the Apple App Store, you additionally acknowledge:

• This agreement is between you and us only, not Apple. Apple has no obligation to furnish any maintenance or support for the App.
• Apple is not responsible for any product warranties, whether express or implied by law. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App; to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims by you or a third party relating to the App, including product liability claims, any claim that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
• Apple is not responsible for the investigation, defense, settlement, and discharge of any third-party claim that the App infringes that third party's intellectual property rights.
• You represent that you are not located in a country subject to a U.S. government embargo or on any U.S. government list of prohibited or restricted parties.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.

13. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Aria Commerce (Exempt dealer under Maayan Milevsky Bassan) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE APP, INCLUDING ANY DECISION MADE OR ACTION TAKEN IN RELIANCE ON NUTRITIONAL ESTIMATES OR AI-GENERATED CONTENT. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

15. Indemnification

You agree to indemnify and hold us harmless from any claim arising from your violation of these Terms or misuse of the App.

16. Governing Law

These Terms are governed by the laws of Israel, without regard to conflict-of-law principles.

17. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified in-app or by email before taking effect. Continued use after changes take effect constitutes acceptance.
